Threaten your bank with court action! - Step 5

Take it to court!

Its legal time! But don’t worry the process isn’t as scary as it sounds. It is a simple online process and in most cases the banks will just pay up.

The small claims court

In the small claims court, typically costs are not awarded to either party, so there’s a lot less at stake. Small claims in England and Wales are cases under £5,000, that’s before any statutory interest is added. If your claim is below this figure great, if not, break your claims up into smaller amounts for different banks.

If your claim is substantially larger, then you’ll be well advised to speak to a solicitor but don’t be put off, remember nobody has lost a case yet.

For those in Scotland and Northern Ireland, the process is slighty different, so you will better off approaching citizens advice about equivalent services available to you.
